Please READ THIS THOROUGHLY. Licensing Info DOES NOT APPLY to personal purchases, i.e, to hang on your wall.

LICENSING IS FOR WORLD-WIDE PROFESSIONAL, COMMERCIAL or EDITORIAL USAGE. Examples are CDs, DVDs, docs, books, mags, online, publicity, merch, etc.

ALL USAGE REQUIRES A LICENSING FEE. DO NOT CONTACT US IF YOU EXPECT FREE PHOTOS! This applies if you are a student, low-budget, non-profit, for profit, donation request or anything. The ONLY exception might be coverage that is 100% about the Jenny Lens Punk Archive. If photo usage is for any other topic, licensing fees apply.

Usage is contingent upon licensee (person/company using photos) and licensor (Jenny Lens) agreeing to ALL terms and providing required information in a timely manner.

NO work initiated until YOU provide budget, deadline, payment schedule, photo info (resolution, size and delivery — details below) and a mutually agreed-upon contract.

To save time and money, YOU need to examine relevant images on my site and provide a list of your needs.

To see additional photos, write me. The more information you share, the more efficient the procress. Obviously we do not release any information regarding your projects.

START HERE:

  1. Start at jennylens.com/bands. Please DO NOT write if band or era (1976-1980) not on list!! If you are looking for someone/event/venue, but no links or missing photos, please write me!
  2. SPECS: determine resolution AND maximum width, height dimensions in pixels for screen, inches/cm for print, preferably BEFORE YOU CONTACT ME! Do not ask for 300 dpi for a newsprint output which should be closer to 100 -150 dpi. FILM-MAKERS: indicate pixel height, width, dpi (72 or 300), AND safe space needed on EACH side.
  3. IF you do not provide this info at the beginning of negotiations, your work order/request will be considered invalid. It is NOT our responsibility to get this info from you! If you don’t know this information, contact us when you do have correct and proper specs to fulfill your needs BUT provide enough time to fulfill the order (or rush charges will be applied!). Don’t place an order until you know this information at THE START OF OUR DISCUSSIONS!
  4. Delivery via FTP or email or what? It is YOUR responsibility to provide this information before we can start work. We will not ask again. Tell us what you need and how to get it to you. You don’t know? Ask someone, your designer, your webmaster, someone must know.
  5. Provide your deadline. A rush fee might apply if applicable. Why are writers given time for research and writing, and the photographers a day or two to provide many photos? Poor planning on your part might result in higher fees.
  6. TO INDICATE PHOTOS: start by copying the url from the address bar. Example: jennylens.com/ramones/_p-s/ramones/ramones01.htm if older site (has black, or black and white background) or if new site, jennylens.com/ramones/ramones.
  7. Type or drag mouse, copy, then paste into email file name located under photos and (some are within brackets []). Example, [77-02-RamLT-22-JoeyKamen].
  8. If a magazine: circulation and street date (not just which issue, but when hitting the streets). Glossy or newsprint paper.
  9. If a book: the publisher and estimated print run. Will contract be with publisher or author? National or world-wide?
  10. Book, CD, DVD, magazine, etc: if front or back cover, ADDITIONAL FEE MIGHT BE APPLIED.

FEES / CONTRACT / PAYMENT

  1. Fees are decided on a case-by-case basis.
  2. A research/scan/posting fee might be required prior to any work being done. Research fees payable whether you use the photos or not. This fee negotiable on a case-by-case basis.
  3. CONTRACTS: stipulations/addendums, revisions must be changed on the contract, not an email. This is a business and applicable laws are observed.
  4. Photographs for specific usage ONLY. NO photographs used for promotion, marketing, press releases, online or audio media (ie., digital, CD, vinyl, tape, etc.) or other visual media (DVD or similar media) unless written permission and possible renegotiation from photographer. Example, you cannot license for a documentary and expect to use in press releases, packaging or online IF not discussed nor specified in the contract.
  5. PAYMENT info: provide YOUR policies upfront.
  6. PAYMENT SCHEDULE: whether you pay 30 days, 50% upfront and 50% upon delivery, or 100% upfront depends upon our negotiations. DO NOT agree to pay upon delivery and then we find out your organization must process a W-9, and typically takes 2-3 months to finally pay. Inform us you need W-9 at the beginning of the project, not the end! Or if your company must generate a work order or whatever. All payment info needed before work commences. Or be prepared to pay more.
  7. We can work with your needs, but if you agree to pay per a certain schedule, and it’s changed because you didn’t OK it with accounts payable, the fee MIGHT BE DOUBLED. Applies to research as well as photo payment.
  8. Payment to Jenny Lens, NOT Jenny Lens Punk Archive. Any checks made to any entity or person other than Jenny Lens herself will not be accepted.

OTHER STIPULATIONS:

  1. If Licensee creates uncredited online images or improperly credits or violates any of the following, FEES WILL BE IMPOSED. Non-negotiable. You make a mistake, you pay.
  2. NO ONLINE (ELECTRONICALLY transmitted/posted) by the Licensee without PROPER PHOTO CREDIT/WATERMARKED!! (credit EMBEDDED ON TOP OF IMAGE, exceptions must be cleared, by Jenny Lens, in writing prior to usage), LIVE LINK [jennylens.com] and PRIOR NOTIFICATION to Licensor of such usage. The Jenny Lens Punk Archive, in many cases, will provide properly credited jpgs for Licensee’s online needs if you provide pixel height or width for watermarked jpgs.
  3. The Jenny Lens Punk Archive is aggressively marketing and promoting ALL projects utilizing these photos. We want everyone to succeed. However, it’s a breach of contract to leave us out of the equation. Agreed upon photo credit must be honored. Payment MUST be agreed upon delivery and date(s).

PHOTO CREDIT / CAPTIONS / DESIGN / LAYOUT:

  1. All photographs will get photo credit: (c) Jenny Lens Punk Archive/Cache Agency. That’s the copyright symbol followed by all four words.
  2. If photo credit is missing or photograph(s) is/are credited to another photographer, TRIPLE USAGE FEES. Licensee will pay THREE times the agreed upon amount.
  3. Photo caption must indicate date, names, etc provided by photographer IF such information is used. You can’t print Joey Ramone in Tokyo, Japan; when Jenny Lens shot him in Little Tokyo, Los Angeles, for example. Incorrect photo caption MIGHT DOUBLE the fee.
  4. Photo credit will be LEGIBLE. DO NOT put the credit on top of a photo so that it blends into the photo! Or credit so small, condensed, etc you need a magnifying glass to read it.
  5. Do not put credit so far above/below the photo or in the gutter the printer either cuts it off or it’s buried so deeply in the gutter you have to practically pull apart the publication to see the credit. A missing credit due to printer errors MIGHT BE DOUBLED.
  6. NO TEXT OVER PHOTOGRAPHS. That means NO TEXT over photos. NO EXCEPTIONS without written permission.
  7. NO CROPPING into a person, head, hat, feet, etc. Make the photo smaller.
  8. Photos will never bleed into gutter or margins or on a spread if integrity of photo is impaired. See #7 above.
  9. DO NOT PRINT A DOUBLE PAGE SPREAD UNLESS YOU ASK FIRST!!! One page per photo. Don’t like that stipulation? Don’t use MY photos.
  10. Do not blame the printer for cutting off part of the image if you didn’t lay it out correctly. Do NOT blame the printer if credit cut off. I’ve been a desktop publisher and if you don’t know the basics, don’t use these photos for a bleed. Jenny crops most photos before delivery. Therefore, indicate if you want full frame for bleed.
  11. NO distorting to fit the photo into a space: Keep the proportions.
  12. DO NOT put a color wash over a shot by reducing the highlights and shadows. The integrity of the image must be maintained or improved. If you color correct and improve tonal value, great! Otherwise, hands-off.

Usage of photos ONLY upon agreement of terms. ANY breach of this contract is subject to a binding, no arbitration/no mediation, default judgment, payable of potentially TRIPLE (or double if previously specified) fees and within 30 days of notification of the violation.

If remedy is not fulfilled as laid out per terms herein, ALL legal costs will be paid by the Licensee for each and every violation if legal action initiated.

Disputes over terms of photographs fall under the Jurisdiction/Venue of California state law, county of Los Angeles, Superior Court, Santa Monica and Federal Laws protecting intellectual property rights.

Legal action is rarely needed. Compliance of promises and agreements with photographer Jenny Lens results in fun, productive projects.
